Terms of Service

1. Acceptance of Terms

By accessing or using FitRecomp ("the Service"), operated by Red Pulse Tek ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FitRecomp is an AI-powered fitness platform that provides:

• Personalized training, nutrition, and health insights generated by artificial intelligence agents
• Integration with third-party fitness services including Strava, Oura Ring, and Apple Health (via HealthKit)
• Automated scoring, progress tracking, and plan generation across training, nutrition, and health domains
• An AI coaching assistant for fitness-related guidance
• Data import via CSV uploads and connected email accounts

3. Not Medical Advice

FitRecomp is a wellness and fitness platform, not a medical service. The AI-generated insights, plans, scores, and coaching responses are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any exercise program, making dietary changes, or acting on health-related information provided by the Service.

We are not a HIPAA-covered entity. The Service does not provide clinical healthcare services and is not intended to replace professional medical judgment.

4. Account Registration and Security

You must create an account to use the Service. Authentication is provided through Clerk (our identity provider) or supported OAuth providers (Google). You are responsible for:

• Providing accurate registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You must be at least 16 years old to use the Service.

5. Third-Party Integrations

The Service integrates with third-party platforms. By connecting these services, you acknowledge:

• Strava: Workout and activity data is imported via the Strava API. Your use of Strava data is also subject to Strava's Terms of Service.
• Oura Ring: Sleep, readiness, and activity data is imported via the Oura API. We comply with Oura's API Agreement and will not sell, market, or license your Oura data to any third party, including advertisers or data brokers. Your use is also subject to Oura's Terms and Conditions.
• Apple Health (HealthKit): Health and fitness data may be imported from the Health app on your iOS device. In compliance with Apple's HealthKit guidelines, we will not use HealthKit data for advertising or marketing purposes, nor will we sell it to data brokers. See our Privacy Policy for details.

We are not responsible for the availability, accuracy, or policies of third-party services.

6. AI-Generated Content

The Service uses large language models (LLMs) to generate training plans, nutrition recommendations, health summaries, scores, and coaching responses. You acknowledge that:

• AI-generated content may contain inaccuracies, errors, or recommendations that are not suitable for your individual circumstances
• AI outputs are probabilistic and may vary between sessions even with the same inputs
• You should exercise your own judgment and consult professionals before acting on AI recommendations, especially regarding exercise intensity, caloric intake, or health concerns
• We do not guarantee specific fitness results from following AI-generated plans

7. User Data and Content

You retain ownership of all data you provide to the Service, including logs, goals, and uploaded files. By using the Service, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing and improving the Service.

You agree not to upload content that is unlawful, harmful, or infringes on third-party rights.

8. Acceptable Use

You agree not to:

• Use the Service to harm, harass, or impersonate others
• Attempt to reverse-engineer, scrape, or exploit the Service or its APIs
• Circumvent security measures, authentication, or access controls
• Use automated tools (bots, scrapers) to access the Service without authorization
• Resell, redistribute, or sublicense access to the Service

9. Subscription and Payments

Certain features may require a paid subscription. Subscription terms, pricing, and billing cycles will be presented at the time of purchase. We reserve the right to change pricing with reasonable notice. Refunds are handled on a case-by-case basis.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Red Pulse Tek and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Physical injury resulting from following AI-generated training or nutrition plans
• Inaccurate health data or scoring from third-party integrations
• Loss of data or service interruptions
• Decisions made based on AI-generated content

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Red Pulse Tek from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may delete your account at any time by contacting bekim@redpulsetek.com. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.
